Battery Warranty for BMZ E-Bike Batteries in Nox Cycles Austria GmbH E-Bikes

1. BMZ Germany GmbH manufactures BMZ E-Bike batteries and is based at Zeche Gustav 1, D-63791 Karlstein am Main, Germany. Nox Cycles Austria GmbH manufactures E-Bikes and is based at 6262 Schlitters, Gewerbegebiet Süd 3 (Austria). These terms and conditions apply exclusively to the warranty program for BMZ E-Bike batteries sold and offered by Nox Cycles Austria GmbH, starting with the 2025 model year (V 10 battery). The warranty program applies exclusively to new BMZ E-Bike batteries in new Nox Cycles Austria GmbH bikes; "retrofits" are not covered by the warranty program. These terms and conditions govern all services under the battery warranty for BMZ E-Bike batteries.
   
   The seller and warranty provider is Nox Cycles Austria GmbH.

2. Agreeing to these warranty terms and conditions during the registration process on the website and registering the E-Bike and battery is a mandatory prerequisite for claiming warranty services. If the customer does not explicitly agree to these terms, they are not allowed to claim warranty services.
   
   Another mandatory condition for claiming warranty services is the customer’s agreement to the other general terms and conditions of Nox Cycles Austria GmbH. Customers who do not wish to comply with the general terms and conditions of Nox Cycles Austria GmbH cannot claim warranty services from this battery warranty.
   

3. The sale with warranty service for BMZ E-Bike batteries is intended for users, which may include both natural and legal persons who have purchased a BMZ E-Bike battery in a Nox Cycles Austria GmbH E-Bike and registered for the warranty program.
   
   

4. The current privacy policy is available at https://www.noxcycles.com/datenschutz-noxcycles and can be reviewed to understand what data the user collects and how it is processed.
   
   

5. The provisions of these warranty terms apply between Nox Cycles Austria GmbH and the user/customer who has registered for the warranty program. Third parties cannot derive any claims from this. The assignment of the user/customer's rights under the contract without prior consent from Nox Cycles Austria GmbH is excluded and impermissible.
   
   

6. Nox Cycles Austria GmbH may transfer rights and obligations from the sales conditions and warranty terms to third parties in compliance with legal requirements.
   
   

7. Nox Cycles Austria GmbH reserves the right to use appropriate service providers, such as shipping companies, to fulfill the obligations arising from the contract with the user, particularly in compliance with data protection obligations.
   
   

8. If one or more provisions of these warranty terms are ineffective, the remaining provisions will remain unaffected.
   
   

9. In case of legal disputes, the law of the Republic of Austria shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In dealings with consumers within the European Union, the law of the consumer's residence or habitual residence applies, provided that it concerns mandatory consumer protection provisions.
   
   

10. The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual and warranty relationship is the court responsible for 6262 Schlitters, Austria. With consumers, the court at the consumer's residence may have jurisdiction, if this is not waivable according to EU regulations.
    
    

11. The European Commission provides an online dispute resolution platform (ODR). Nox Cycles Austria GmbH is neither obliged nor willing to participate in dispute resolution procedures before a consumer arbitration board.
    
    

12. Set-off and retention rights are only available to the customer/user to the extent that counterclaims have been legally established or are undisputed.
    
    

13. The place of performance is 6262 Schlitters, Gewerbegebiet Süd 3.
    
    

14. Nox Cycles Austria GmbH offers a "Lifetime Warranty" for BMZ E-Bike batteries installed in Nox Cycles E-Bikes starting with the 2025 model year with V10 batteries, which are used in Nox Amplifier P2 models and future RS-Motor upgrade bikes. This "Lifetime Warranty" lasts for 10 years from the delivery date to the first owner (purchaser) of the E-Bike along with the battery.
    
    

15. The warranty is limited to the first owner (purchaser) of the E-Bike and is non-transferable.
    
    

16. An annual check of the battery is mandatory and must be conducted by an authorized Nox Cycles Austria GmbH service partner. A capacity tester will be used to check the condition of the battery (state of health, SOH). If the capacity is below 70% SOH, the battery is a warranty case.
    
    

17. Nox Cycles Austria GmbH strives to meet user/customer satisfaction. However, the intended deadlines can only be met if the customer/user provides all necessary prerequisites and documents to Nox Cycles Austria GmbH and complies with their other obligations.
    
    

18. A prerequisite for warranty service is the registration of the E-Bike and battery. This registration must be completed online within 90 days from the purchase date (purchase date) via the warranty landing page. The following information and documents must be provided: - Name and contact details of the buyer - Frame number of the E-Bike and battery serial number - Purchase date and dealer details - Delivery date of the bike and battery to the user/customer - Upload of the original invoice.
    
    

19. The user and owner of the bike and battery are required to have the bike and battery serviced annually by an authorized Nox Cycles Austria GmbH service partner. The maintenance must include checking the battery condition (charge cycles, capacity, efficiency), checking the electrical systems (motor, controller, wiring), performing software updates promptly, and a general safety check. All maintenance results and inspections must be documented in the service portal with a timestamp by the authorized service partner. Actions performed by a service partner selected by the customer are attributed to the customer and fall under their responsibility.
    
    

20. The user is required to use and store the battery properly and adhere to recommended maintenance intervals. In the case of a warranty claim, the user must provide the original invoice and confirmation of regular annual maintenance.
    
    

21. In case of a warranty claim, the battery will either be repaired or replaced with an equivalent battery, at the discretion of the warranty provider. The decision of repair or replacement rests with the warranty provider after reviewing the warranty claims. The warranty does not cover transportation costs for the battery or E-Bike, nor any other incidental costs.
    
    

22. The warranty does not cover damages caused by improper use, overvoltage, use outside specified conditions (e.g., extreme temperatures), or modifications to the battery. The warranty is also excluded for accident damage, damage due to neglect of maintenance and storage guidelines. If repairs are done in unauthorized workshops, warranty service is no longer valid.
    
    

23. The warranty provider is not liable for indirect damages, consequential damages, or lost profits, unless they were caused intentionally. Personal injuries are not covered by the warranty.
    
    

24. The warranty ends upon the sale of the E-Bike to third parties. Additionally, the warranty ends if the annual maintenance by an authorized Nox Cycles Austria GmbH service partner is not carried out.
    
    

25. The batteries are recycled at the end of their life cycle when returned by the customer or service partner. Proper separation and environmentally responsible disposal in accordance with Article 10 of the EU Battery Regulation is ensured. Manufacturers and retailers are required to take back used batteries and ensure environmentally responsible disposal and recovery of valuable materials. Documentation in the recycling process will be provided.
    
    

26. Otherwise, statutory warranty rights and Austrian civil law apply. Granting a separate battery warranty does not affect statutory warranty rights.
    
    

27. Claims under this warranty expire within one year from the legal start of the limitation period.
    
    

28. Further claims for reimbursement of expenses or damages, regardless of the legal reason, are otherwise excluded.
    
    

29. Force majeure, labor disputes, natural disasters, and transport blockades, as well as other circumstances outside the control of Nox Cycles Austria GmbH, exempt it from providing warranty services. As long as Nox Cycles Austria GmbH has not fallen into default with the warranty service or its rectification, and this has not ultimately failed, the customer/user is not entitled to have third parties remove defects. Warranty service (battery repair or replacement) does not reset or revive the statutory warranty period.
    
    

30. The use of all copyrighted material is only permitted for private purposes in connection with the intended use.
    
    

31. Nox Cycles Austria GmbH assumes no responsibility for content on the website not created by Nox Cycles Austria GmbH itself.
